These Terms and Conditions of Sydney Garage Door Repair (the “Terms and Conditions”) are incorporated into every customer contract, quote, estimate, or other written proposal of work of Sydney Garage Door Repair (the “Contractor”). Customer is defined as a homeowner or other contractor who has entered into a written contract with Contractor to perform work. The Terms and Conditions are not transferable or assignable.
1. Services
1.1 Contractor will perform all services for Customer in accordance with generally acceptable industry standards of other competent contractors performing the same or similar services in Sydney, Australia.
2. Estimates
2.1 Any estimate provided to Customer is effective for thirty (30) calendar days from the date of issuance. After the expiration of the 30-day period, Customer will be required to obtain a new estimate from Contractor.
2.2 Estimates do not include painting, touch-ups, or later requested alterations or deviations from the original scope of work.
3. Acceptance/Approval
3.1 To become a binding contract, all estimates must be approved in writing by the Customer. Approval in writing may be made by email or other written means.
3.2 Any changes or cancellations made after approval are subject to Contractor’s acceptance and may require additional charges.
4. Payment Terms
4.1 For homeowners: A minimum payment of 50% of the provided estimate is required in advance for all installations and special orders. Special orders are non-refundable. The remaining balance must be paid immediately upon completion of work.
4.2 For contractors: Payment terms will be as agreed upon in writing.
4.3 Delinquent accounts will be subject to finance charges of 18% per annum or the maximum rate allowed by law. Any costs of collection, including attorney’s fees and court costs, will be the responsibility of the Customer.
5. Site Conditions
5.1 Customer is responsible for securing permissions for access to properties required for the Contractor’s work. Customer shall indemnify Contractor against all actions arising from such access.
5.2 The worksite must be cleared and secured before and during the Contractor’s work. Customer is responsible for removing or protecting all property, including furniture, vehicles, and vegetation.
6. Special Orders
6.1 Customer is responsible for inspecting special orders to verify accuracy upon delivery. If unsatisfied for reasons other than damage, Customer must bear the costs of exchanges, including price differences and restocking fees.
7. Limited Warranty
7.1 Contractor warrants materials and workmanship to be free from defects for one (1) year from the date of installation, provided materials are manufactured and/or installed by Contractor.
7.2 The warranty does not cover:
Defects caused by Customer’s site conditions or modifications.
Abuse, misuse, negligence, or acts of God.
Painting or other modifications performed by anyone other than Contractor.
7.3 All warranty claims must be made in writing within 24 hours of discovery. Contractor will be given the first opportunity to repair any defects.
8. Limitation of Liability
8.1 Contractor is not liable for direct, incidental, or consequential damages, including bodily injury or property damage, regardless of cause.
8.2 Contractor’s liability will not exceed the total payments made by the Customer for goods and services.
9. Unforeseen Conditions
9.1 Customer accepts responsibility for unforeseen site conditions and agrees to pay for additional labor, materials, or repairs caused by such conditions.
10. Additional Work
10.1 Any additional work not specified in the original contract will be subject to additional charges, and Customer agrees to pay promptly for such work.
11. Governing Law and Dispute Resolution
11.1 These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
12. Amendments
12.1 These Terms and Conditions may not be amended unless agreed to in writing by both parties.
